No deduction is allowed for tax years after 2028 unless Congress extends it.
Is no tax on tips in effect now?
Yes. It became law on July 4, 2025, as section 224 of the Internal Revenue Code. Tips from January through June 2025 count the same as tips received after the law passed.
2025 was a transition year
Employers didn't have to report qualified tips separately on 2025 W-2s. IRS Notice 2025-69 lets employees use the social security tips in box 7 of the W-2, or tips reported on Form 4137, and lets self-employed workers use their 1099 and platform records.
If you filed your 2025 return without the deduction, you can claim it with an amended return, Form 1040-X, generally within three years.
From 2026, employers report it
Starting with 2026, employers and payment platforms report tips and the recipient's tipped occupation on W-2s and 1099s, so the number you need will be on the forms you receive in January 2027.
Your paycheck doesn't change
Withholding continues as before. The saving shows up as a bigger refund or a smaller bill when you file. If you'd like it sooner, you can account for the deduction on a new Form W-4.
